2. Filing a Takedown Notice

To submit a copyright takedown notice under 17 U.S.C. §512(c)(3), use the DMCA report form or send your notice directly to our designated agent listed above. We currently accept notices only for Colora post URLs in the format https://getcolora.com/p/<postId>.

Your notice must include information reasonably sufficient for us to process it, including:

• Your full legal name, physical address, telephone number, and email address.
• Identification of the copyrighted work you claim has been infringed (or a representative list).
• Identification of the allegedly infringing material on Colora (the Colora post URL) sufficient for us to locate it.
• A statement of good faith belief that the use is not authorized by the rights holder, its agent, or the law.
• A statement, under penalty of perjury, that the information is accurate and you are the rights holder or authorized to act.
• Your electronic signature.

3. Counter-Notice

If your content was removed or disabled due to mistake or misidentification, you may submit a counter-notification under 17 U.S.C. §512(g) using the counter-notice form or by sending a written counter-notice to our designated agent listed above.

After we receive a valid counter-notice, we will promptly forward a copy to the original claimant. If the original claimant does not notify us within 10 to 14 business days that they have filed a court action to restrain the allegedly infringing activity, we will restore access to the removed material in accordance with 17 U.S.C. §512(g)(2)(C).

A counter-notice must include:

• Your full legal name, physical address, telephone number, and email address.
• Identification of the material that was removed or disabled (for example, the Colora post URL).
• A statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification.
• A statement consenting to the jurisdiction described in 17 U.S.C. §512(g)(3) and acceptance of service of process from the claimant.
• Your electronic signature.

4. Repeat Infringer Policy

In accordance with 17 U.S.C. §512(i), Colora has adopted and reasonably implements a policy for the termination of users who are repeat infringers. Under our current policy, users who accumulate three (3) upheld copyright infringement strikes will have their accounts permanently terminated. We also reserve the right to terminate any account at any time if a single infringement is sufficiently egregious.

5. False Statements

Knowingly making material misrepresentations in a DMCA notice or counter-notice may result in legal liability, including under 17 U.S.C. §512(f).

6. Processing

Upon receiving a valid takedown notice that substantially complies with 17 U.S.C. §512(c)(3), Colora will act expeditiously to remove or disable access to the allegedly infringing material. Our processing includes:

• Expeditiously removing or disabling access to material identified in a valid notice.
• Promptly notifying the user who posted the material that their content has been removed due to a copyright complaint, and providing them with a copy of the notice and information about how to file a counter-notice.
• Accepting and processing counter-notices that comply with 17 U.S.C. §512(g)(3) and promptly forwarding them to the original claimant.
• Restoring access to removed material not less than 10 and not more than 14 business days after receiving a valid counter-notice, unless the claimant notifies us that they have filed a court action to restrain the allegedly infringing activity.
• Recording each upheld notice as a strike against the posting user’s account in accordance with our repeat infringer policy.

We may request additional information if a submission is incomplete. We may reject submissions that are abusive, incomplete, or not related to content hosted on Colora.
